End User License Agreement
This End User License Agreement ("EULA") is a legal agreement between you and Elyes & Yassine LTD, located at Phoenix Business Centre, Old Railway Track, Malta, for the DreamPath: AI Chatbot mobile application ("Application"), which includes computer software and may include associated media, printed materials, and online or electronic documentation ("Software").
By installing, accessing, or otherwise using the Application, you affirm that you are at least 13 years old, and you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install, access or use the Application.
License Grant: Elyes & Yassine LTD grants you a personal, non-exclusive, non-transferable, non-sublicensable, revocable limited license to use the Software solely for your own personal, non-commercial purposes, subject to the terms and conditions of this EULA.
Restrictions: You may not sell, rent, lease, transmit, host, or otherwise commercially exploit the Application; modify, translate, adapt, merge, make derivative works of, disassemble, decompile, reverse compile or reverse engineer any part of the Application except to the extent allowed under applicable law; or remove, alter or obscure any proprietary notice or labels on the Application.
Intellectual Property Rights: The Application and all content and materials therein are the exclusive property of Elyes & Yassine LTD. All rights, titles, and interests in and to the Application are reserved by Elyes & Yassine LTD.
Updates: Elyes & Yassine LTD reserves the right to modify or discontinue the Application at any time and is not obligated to provide any maintenance, technical or other support for the Application.
User Content: By sharing User Content through the Application, you grant Elyes & Yassine LTD a worldwide, perpetual, unlimited, irrevocable, transferable, royalty-free license to use, copy, modify, distribute, transmit, sublicense, and display such User Content in any manner Elyes & Yassine LTD sees fit, without any obligation to pay any royalties or other compensation to you.
Privacy Policy & Personal Information: By using this Application, you acknowledge and agree that certain personal information may be collected by Elyes & Yassine LTD as detailed in our Privacy Policy located at: www.dreampathai.com/privacy-policy.
Disclaimer of Warranties: THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELYES & YASSINE LTD SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY OTHER DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE APPLICATION.
Termination: Elyes & Yassine LTD reserves the right to terminate this EULA immediately if you fail to comply with any term of this EULA. You may terminate this EULA at any time by uninstalling and destroying all copies of the Application in your possession or control. Upon termination, all license rights granted to you under this EULA will immediately cease.
Dispute Resolution: Any disputes arising out of or relating to this EULA shall be resolved first through good faith negotiations between the parties. If such negotiations fail, the dispute shall be referred to mediation administered by a mutually agreed upon mediator. If mediation fails, the dispute shall be submitted to final and binding arbitration under the rules of the Malta Arbitration Centre. The arbitration shall take place in Malta. Notwithstanding the above, Licensor reserves the right to seek injunctive relief against you in any court of competent jurisdiction to enjoin infringement of intellectual property rights.
Entire Agreement, Governing Law, and Severability: This EULA is the entire agreement between you and Elyes & Yassine LTD relating to the Application and supersedes all prior oral or written communications and representation with respect to the Software or any other subject matter covered by this EULA. If any of the provisions of this EULA is held to be void, unenforceable or illegal, the other provisions shall continue in full force and effect. This EULA shall be governed by and construed under the laws of Malta.
